App Stores – Apple App Store for iOS and Google Play Store for Android.
Content – Any text, images, videos, data, or other materials uploaded, transmitted, or displayed on the Platform by Users or Autfitter.

In-App Purchases – Digital goods or services purchased through the App Stores.

ACCOUNT REGISTRATION & SECURITY
To access certain features, you may be required to create an Account and provide accurate, current, complete, truthful, and lawful information. You agree to update such information promptly.
You are responsible for safeguarding your Account credentials and for all activities occurring under your Account.
You must notify us immediately of any unauthorized use or security breach.
PLATFORM SCOPE
The Services are made available via:
Website accessible through standard web browsers.
Mobile Applications available for download from the Apple App Store (iOS) and Google Play Store (Android).
COMMERCIAL MODEL & BILLING
Autfitter operates under the following models:
Free Tier – Limited access at no cost.
Freemium – Free basic access with optional paid features.
Subscription-Based Access – Monthly, quarterly, or annual recurring plans.
In-App Purchases – One-time purchases for additional features or content.
Payments for Subscriptions and In-App Purchases are processed through the relevant App Stores. Autfitter does not directly handle payment processing for mobile app purchases. Billing terms, pricing, and available plans are displayed at the point of purchase within the applicable App Store.
SUBSCRIPTION PLANS
Autfitter offers a range of auto-renewable subscription plans designed to meet different user needs:
Stylist Subscription
Designed for professional stylists, offering access to advanced tools. Might be available in various billing periods, including weekly, biweekly, monthly, annual, and other options.

Provides access to advanced app features and AI personalized wardrobe tools. Available in flexible billing intervals, such as weekly, monthly, annual, or other available options.
Subscription prices and available billing options may vary depending on the region and currency.
All subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription anytime in your App Store account settings.
REFUND POLICY
Refund requests must comply with the Apple App Store and Google Play Store refund policies, which may vary by jurisdiction. Autfitter does not process refunds directly for purchases made through the App Stores.
BILLING, CANCELLATION & SUBSCRIPTION MANAGEMENT
10.1 Billing
All payments for Subscriptions and In-App Purchases are processed by the Apple App Store or Google Play Store under their respective payment systems. You agree to comply with all payment terms and conditions of the relevant App Store.
10.2 Auto-Renewal
Unless you cancel your Subscription before the end of the current billing period, your Subscription will automatically renew at the then-current subscription fee and billing cycle.
10.3 Cancellation
You may cancel your Subscription at any time through your Apple or Google account settings. Cancellation will become effective at the end of the current billing period, and you will continue to have access until then. No prorated refunds are provided. To cancel, you must follow the cancellation process through the applicable App Store. Failure to cancel in accordance with App Store policies may result in continued charges.
10.4 Refunds
Refunds for purchases are governed solely by the refund policies of the Apple App Store and Google Play Store. Autfitter does not directly issue refunds for any purchases made through these platforms, except as required by applicable law.
USER CONTENT & LICENSE GRANT
11.1 Ownership
All payments for Subscriptions and In-App Purchases are processed by the Apple App Store or Google Play Store under their respective payment systems. You agree to comply with all payment terms and conditions of the relevant App Store.
11.2 License Grant
By submitting User Content, you grant Autfitter a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, perform, and create derivative works of your User Content solely for the purposes of providing, promoting, improving, and analyzing the Services, including AI model training in anonymized form.
11.3 Representations
You represent and warrant that you own or otherwise have the necessary rights and permissions to grant the above license and that your User Content does not violate any third-party rights or applicable laws
11.4 Content Monitoring
Autfitter reserves the right, but does not assume any obligation, to monitor, review, or remove any User Content that violates these Terms or is otherwise objectionable.
INTELLECTUAL PROPERTY RIGHTS
12.1 Proprietary Materials
All content and materials provided by Autfitter excluding User Content (“Proprietary Materials”), including but not limited to text, graphics, designs, software, AI-generated content, trademarks, logos, and trade dress, are owned or licensed by Autfitter and protected by applicable intellectual property laws.
12.2 Restrictions
You agree not to copy, modify, distribute, create derivative works, publicly display, or otherwise exploit any Proprietary Materials without Autfitter’s prior written consent.
12.3 Trademarks
The Autfitter name, logos, and related trademarks are the exclusive property of Autfitter. Unauthorized use is strictly prohibited.
ACCEPTABLE USE
You agree not to:
Use the Services for any unlawful or unauthorized purpose;
Upload or distribute content that infringes on third-party rights or is illegal, harmful, or offensive;
Interfere with the security or integrity of the Platform;
Attempt to reverse-engineer or gain unauthorized access to the Services or related systems;
Use automated systems or software to extract data or engage in unauthorized data collection;
Harass, intimidate, or harm other users or Autfitter personnel;
Circumvent access controls or restrictions implemented on the Platform;
Use the Platform to compete commercially with Autfitter or to resell the Services without prior written consent;
Collect or store sensitive personal data unless explicitly authorized.
LIMITATION OF LIABILITY
To the fullest extent permitted by law:
14.1 Autfitter shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services.
14.2 Autfitter’s total liability arising out of or related to these Terms or the Services shall not exceed the amount paid by you to Autfitter during the twelve (12) months prior to the event giving rise to the claim.
14.3 Autfitter does not guarantee uninterrupted or error-free operation of the Platform and is not responsible for damages arising from service interruptions, data loss, or failures.
14.4 Some jurisdictions do not allow the exclusion or limitation of certain damages, so some limitations may not apply to you.
FORCE MAJEURE
Autfitter shall not be liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, strikes, government actions, or failures of third-party services.
ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without prior written consent from Autfitter. Any attempt to assign without consent is void. Autfitter may assign or transfer its rights and obligations without restriction.
EXPORT CONTROL
You agree to comply with all applicable export laws and regulations and not to use or export the Services in violation of any such laws, including restrictions on exports to sanctioned countries or entities.
ACCESSIBILITY

CONSUMER RIGHTS NOTICE
These Terms do not limit any statutory consumer rights that you may have under applicable law, which cannot be waived or limited.
SEVERABILITY
If any provision of these Terms is held invalid or unenforceable by a court or regulatory authority, the remainder of these Terms shall remain in full force and effect. Any invalid provision shall be replaced by a valid provision that most closely approximates the intent of the original.
ENTIRE AGREEMENT
These Terms, together with the Privacy Policy incorporated by reference, constitute the entire agreement between you and Autfitter relating to the Services and supersede all prior agreements.

DISPUTE RESOLUTION & GOVERNING LAW
Both you and Autfitter agree to use all reasonable efforts to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services amicably before initiating any formal legal proceeding.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Delaware for any disputes not resolved amicably.
